These terms cover the use of this website. The separate class terms cover what happens once you book a trial or enroll a child.
Effective
This website is operated by BesterTogether LLC, doing business as The Ballet Garden, of San Clemente, California. In these terms, “we” and “us” mean that business, and “you” means the person using the site.
By using this website you accept these terms. If you do not accept them, please do not use the site.
You must be at least 18 to use this site. When you book or enroll a child, you confirm that you are their parent or legal guardian, or that you have that person’s authority to act for the child.
The parent portal signs you in with a one-time link sent to your email address, so keeping that mailbox secure is what keeps your family’s records secure. Anyone who can read your email can sign in as you.
Tell us at jess@bestertogether.com if you lose access to that address or think someone else has used it to reach your records.
Please keep the information you give us accurate and current, particularly emergency contacts and anything about your child’s health.
Trials, enrollment, tuition, refunds, and everything else about attending a class are governed by our class terms, which you accept separately when you book. Where the two documents differ on a class matter, the class terms apply.

The name The Ballet Garden, our logo, the writing, photographs, illustrations, and class material on this site belong to us or are used with permission. You are welcome to view, print, and share pages for your own personal and non-commercial use. Anything beyond that — republishing, copying our class descriptions, or using our brand — needs our written permission first.
We aim to keep the site available, but we do not promise it will be uninterrupted or error-free. We may change, suspend, or withdraw any part of it, and we may need to take it offline for maintenance.
Class times, spaces, and prices are shown from live data and we work to keep them correct. Even so, a listing can be out of date or contain an error, and availability can change while you are reading it. A place is only yours once we confirm it, and we may correct an obvious pricing error before taking payment. If we do, we will tell you and you may cancel for a full refund.
Payments are taken through Stripe, on Stripe’s own pages and under Stripe’s terms. Where we link to another website, we do so for convenience and are not responsible for its content.
The site is provided as it is and as available. To the fullest extent the law allows, we exclude implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, or lost opportunity arising from your use of this website. Our total liability arising out of the website is limited to the amount you paid us in the twelve months before the claim.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Some limitations do not apply in California, and where that is so, they do not apply to you.
Our privacy policy explains what we collect and why, and forms part of these terms.
These terms are governed by the laws of the State of California. Any dispute will be heard by the state or federal courts serving Orange County, California, and we each agree to that venue. Nothing here prevents you from bringing a claim in small claims court.
We may update these terms. The effective date at the top of this page shows when the current version took effect, and continuing to use the site after that means you accept it.
